FINAL DISMISSAL OF THE PATENT LAWSUIT BY CONCRETE CANVAS AGAINST EUROBENT.
TILTEX AND TILTEX PLUS CLEARED OF PATENT INFRINGEMENT ALLEGATIONS.
On 31 March 2025 Court of Appeals in Poznań, Poland dismissed the appeal (case ref. no. I AGa 331/22) brought by Concrete Canvas Technology Ltd (“Concrete Canvas”) and thereby confirmed the earlier judgement of Regional Court in Legnica issued on 9 May 2022, which dismissed the lawsuit against Eurobent Sp. z o.o. alleging the infringement of Concrete Canvas’ patent EP 2027319 (case ref. no.VI GC 184/18) [as described in Eurobent’s earlier press release of 13 May 2022, issued after the first instance judgement].
The recent judgement terminated the main court action by Concrete Canvas in Poland, running since 2018, based on the allegation that such patent is infringed in the territory of Poland by manufacturing, selling and exporting TILTEX and TILTEX Plus products. It was in connection with such lawsuit, that Concrete Canvas had obtained and enforced a preliminary injunction against Eurobent and had published numerous press releases about many minor procedural developments, attempting to paint the false picture of Eurobent losing in courts. A similar action concerning the same products under a different trade name in Germany had been conducted in the German jurisdiction and was dismissed earlier by a final judgement of the Higher Regional Court in Düsseldorf.
The judgement of the Court of Appeals is final, binding and enforceable, and confirms resolution of the dispute fully in Eurobent’s favour. It cannot be appealed against and can only be challenged in special procedure before the Supreme Court, which is very rarely granted. The court in Legnica has found that TILTEX and TILTEX Plus are neither embodiments of the invention protected by EP 2027319, nor contain its equivalents.
Now the Court of Appeals in Poznań has sided with such assessment. These judgements together fully validate Eurobent’s position, consistently presented during the proceedings, that TILTEX and TILTEX Plus do not infringe intellectual property, but are advanced products created by Eurobent Sp. z o.o. in full compliance with law, which can be legitimately manufactured and traded in Poland, just as in the other countries of the world.
Concrete Canvas’ accusations to the contrary, have shown to be false.
The cost of the proceedings before the Court of Appeals have been awarded in full to Eurobent. Additionally, based on 31 March 2025 judgement Eurobent will immediately demand repayment by Concrete Canvas the costs of enforcement of preliminary injunction in the form of compulsory sum of approx. EUR 1,000,000, previously collected by Concrete Canvas.
